Right of withdrawal and return of goods
On the basis of Section 12 of the Consumer Rights Protection Law, natural persons (hereinafter - Purchasers) who have purchased goods in Creatrade Ltd, registration No 42103110398, registered office: Dravnieks Street 6 - 10, Riga, LV-1021, Tel. +371 28611561; e-mail address: firstname.lastname@example.org, owned and administered Internet the www.paintme.lv website has the right to exercise the right of withdrawal.
1. General issues
1.1. The buyer, who is a natural person, has the right, without giving reasons, to withdraw from the Product within 14 (fourteen) days, if it was not used, damaged or its appearance has not changed in substance, i.e. the appearance of the goods or its packaging was made only such changes as were necessary to examine the goods received. The purchaser must exercise this right responsibly and return the item to the original in a proper packaging, and return all components of the Item.
1.2. Return costs in exercising the right of withdrawal must be borne by the Purchaser.
1.3. In some cases specified by the Salesperson, quality Goods may also be returned in the longer term.
2. Procedures for the exercise of the right of withdrawal and Return of Goods:
2.1. The buyer closes the withdrawal form;
2.2. The customer sends the completed withdrawal form to the Creatrade SIA e-mail address in email@example.com;
2.3. Goods whose right of withdrawal has been exercised by Buyer, Salesperson and Buyer shall be individually agreed. On acceptance of goods - transfer in the event of the exercise of the right of withdrawal, the Party shall sign the instrument of acceptance - transfer;
2.4. The salesperson returns the return of money to the bank account specified in the Buyer withdrawal form within 14 (fourteen) days of the Return Date. The seller undertakes not to hesitate with making a refund.
3. Quality of the goods in exercising the right of withdrawal
3.1. The item must be returned to the original packaging and package. When returning, a sales tax invoice must be submitted and the order number must be provided.
3.2. The sales item to be returned is under the responsibility of the purchaser. If the Item is not completed, the Salesperson shall not accept the Goods to be returned.
3.3. The buyer cannot exercise the right to return the goods purchased in the Internet shop if:
3.3.1. The product is manufactured according to the directions of the purchaser or the Item is clearly personalized (tailored to the personal needs of the purchaser);
3.3.2. The purchaser has opened the packaging of a product which cannot be returned for health and hygiene reasons;
3.3.3. The goods have irreversibly mixed with other cases following delivery;
4. Non-conforming or part-handled goods
4.1. In the event that the goods are assembled inaccurately, the purchaser has the right to return or exchange the item within 14 (fourteen) days. The Buyer shall inform the Salesperson in the form of communication referred to in paragraph 6.3 of the Treaty of an inaccurate assembly of goods. In that case, all costs related to the transport of goods, if any, shall be borne by the Salesperson.
4.2. In the event that the goods are not of high quality and damaged, the Purchaser has the right to inform the Salesperson immediately, return or exchange the Goods within 14 (fourteen) days. The purchaser shall inform the Salesperson of the receipt of defective goods in the form of communication referred to in paragraph 6.3 of the Treaty. In that case, all costs related to the transport of goods, if any, shall be borne by the Salesperson. In the case of poor quality goods, the Buyer shall, as far as possible, carry out the photofixation of the poor good.
4.3. A buyer who wishes to report items of non-conforming quality or package may do so by writing a free-form message to an e-mail address in firstname.lastname@example.org, indicating:
4.3.1. the order number of the item;
4.3.2. Defects, defects or missing parts;
4.3.3. other evidence must be provided, such as a photograph of the product, a photograph of the defect site (if it is mechanical damage and it is possible to photograph it), a photograph of the packaging of the product, etc.
4.4. When submitting a report, the Buyer must indicate one of the following ways of resolving the claim:
4.4.1. The seller must, without consideration, rectify the non-conformity of the Product within a reasonable time-limit, where the deficiencies can be rectified;
4.4.2 to replace the Product with an analogous item of appropriate quality, except in cases where the deficiencies are minor or arise due to the fault of the purchaser;
4.4.3 annul the Agreement and repay to the Buyer the amount of money paid for the Goods if the sale of goods of a non-conforming quality is a material violation of the order.
4.5. When examining the report, the Salesperson shall reply within 14 (fourteen) days. In the event of a refund, the Salesperson shall reimburse to the Buyer the cash for the Item and its delivery expenses.
5. Damaged consignment
5.1. Check the quality of the consignment delivered to the papacate immediately. If you found it damaged:
5.1.1. immediately inform the Salesperson, writing a free-form report, indicating the nature of the damaged packaging, adding photographs;
5.1.2. inspect the goods inside the packaging and, if damaged, lock the damage with photographs. Photographs will be required for the Return of Goods procedure;
5.2. In the event that the goods inside the packaging are damaged, the matter shall be dealt with in accordance with the procedure laid down in paragraph 4.
6. Other issues
6.1. The right to withdraw from a distance contract within 14 (fourteen) days without giving reasons shall not apply to legal persons (economic operators).
6.2. Disputes between Buyer and Salesperson should be settled by mutual negotiation. If the Salesperson refuses to satisfy the Buyer's complaint or the Buyer does not agree with the solutions proposed by the Salesperson and states that his or her rights or interests were infringed, the Buyer may refer the complaint to the Consumer Offshore Dispute Commission, which deals with consumer disputes (more information on dispute settlement is available in http://www.ptac.gov.lv/lv).
